By placing a deposit, making a payment, or purchasing a puppy from Liberty Springs Shepherds, the Buyer acknowledges that they have read, understand, and agree to the following terms.

All deposits, partial payments, and payments made toward the purchase of a puppy are non-refundable.

A deposit reserves a specific puppy or secures the Buyer's position on a waiting list and removes that puppy from consideration by other prospective buyers. Therefore, all monies paid are forfeited if the Buyer changes their mind, is unable to complete the purchase, or fails to comply with the terms of this agreement.

All puppy sales are final unless otherwise covered by the Serious Genetic Health Warranty outlined below.

No refunds will be issued for:

• Change of mind
• Family circumstances
• Landlord restrictions
• Allergies
• Financial hardship
• Personal preference
• Training difficulties
• Behavior concerns
• Coat type or coat color development
• Eye color development
• Ear carriage
• Size, weight, or appearance expectations

If you are seeking a specific coat type, coat color, eye color, markings, ear set, size, or other physical characteristic and wish to place a deposit, please understand that these features continue to develop as the puppy matures.

Any opinion provided by Liberty Springs Shepherds regarding a puppy's future appearance is an estimate only and is not a guarantee.

The following are specifically not guaranteed:

• Adult coat type
• Adult coat color
• Adult eye color
• Adult markings or pattern development
• Ear carriage
• Adult size or weight
• Overall appearance as an adult

A deposit or purchase may not be canceled, refunded, or reversed based on the development of any of these characteristics.

Puppies are expected to be picked up at approximately eight (8) weeks of age unless prior arrangements have been approved by Liberty Springs Shepherds.

If a Buyer is unable to pick up their puppy at eight (8) weeks of age, Liberty Springs Shepherds may hold the puppy until nine (9) weeks of age at no additional charge, provided the puppy has been paid for in full.

If a puppy has not been picked up by nine (9) weeks of age and no written boarding agreement has been approved, the Buyer shall be deemed to have abandoned the purchase.

In such event:

• All deposits and payments shall be forfeited.
• The Buyer's rights to the puppy shall immediately terminate.
• Liberty Springs Shepherds may retain, rehome, sell, or otherwise place the puppy with another individual or family.
• The Buyer shall have no claim to the puppy, reimbursement, refund, replacement puppy, or future credit.

If a Buyer is unable to keep a dog purchased from Liberty Springs Shepherds at any point during the dog's life, Liberty Springs Shepherds must be notified immediately.

Under no circumstances may a dog be surrendered to a shelter, rescue organization, pet store, broker, auction, research facility, or third party without first notifying Liberty Springs Shepherds.

Liberty Springs Shepherds reserves the right of first refusal and may elect to take possession of the dog.

The Buyer is responsible for all transportation costs associated with returning the dog.

Acceptance of a returned dog does not create an obligation to provide a refund, replacement, or credit.

Liberty Springs Shepherds provides a one (1) year warranty against serious hereditary or congenital genetic defects.

A serious genetic defect is defined as a hereditary or congenital condition that:

• Significantly shortens the dog's expected lifespan; or
• Creates a chronic medical condition requiring ongoing veterinary treatment or management throughout the dog's life; or
• Severely impacts the dog's ability to function as a normal companion animal.

This warranty does not cover:

• Illnesses, diseases, parasites, infections, viruses, bacteria, or fungi acquired after the puppy leaves Liberty Springs Shepherds.
• Accidents, injuries, neglect, abuse, or improper care.
• Undescended testicle(s).
• Ears that do not stand.
• Coat length or coat type variations.
• Coat color changes.
• Eye color changes.
• Cosmetic imperfections.
• Overbite or underbite unless it significantly interferes with the dog's ability to eat normally.
• Adult size, weight, height, or growth rate.
• The dog not developing to the size, appearance, or physical characteristics expected by the Buyer.

To submit a warranty claim, the Buyer must provide:

• Complete veterinary records.
• Diagnostic testing supporting the diagnosis, when applicable.
• Written documentation from a licensed veterinarian stating the condition is genetic in nature.
• The dog's registration papers.

Liberty Springs Shepherds reserves the right to obtain a second veterinary opinion before approving any claim.

If a covered genetic defect is confirmed, the affected dog must either:

1. Be humanely euthanized due to the severity of the condition, with supporting veterinary documentation provided; or
2. Be permanently altered (spayed or neutered), with proof of sterilization provided.

Dogs receiving warranty benefits may not be used for breeding.

In most cases, the original dog will not be required to be returned.

Approved claims are eligible for one (1) replacement puppy of equal value from a future available litter.

Equal value means:

• Same registration status;
• Same sex; and
• Comparable color classification when reasonably available.

If the Buyer selects a puppy with a higher purchase price, the Buyer shall be responsible for paying the difference.

Replacement puppies are subject to availability and may require a wait for a future litter.

The sole remedy provided under this warranty is a replacement puppy.

No cash refunds, veterinary reimbursements, medication reimbursements, transportation costs, boarding costs, training expenses, or any other monetary compensation shall be provided.

By purchasing a puppy from Liberty Springs Shepherds, the Buyer acknowledges that this replacement policy is the sole and exclusive remedy available under this warranty.
